Important Notice: By accessing, pre-registering, or using the Whaping AI platform, you agree to be bound by these Terms of Service. Whaping provides an autonomous AI assistant layer that pairs to your WhatsApp device to automate customer interactions, catalogs, and bookings with zero per-message markups.

1 Acceptance & Eligibility

These Terms of Service constitute a legally binding agreement between you (whether individually or on behalf of an entity) and Whaping AI Technologies (“Whaping”, “we”, “our”). You must be at least 18 years of age and possess the legal authority to bind your business to these terms.

2 Service Overview & Pairing Protocol

Whaping provides automated conversational software that connects to your WhatsApp or WhatsApp Business telephone number via multi-device QR code pairing:

  • Autonomous Assistance: Whaping executes autonomous catalog lookups, product recommendations, abandoned cart recovery, scheduling, and payment links.
  • Human Takeover: You retain complete ownership of your WhatsApp number and can monitor or intervene in any live chat via the Whaping Live CRM dashboard or your native WhatsApp mobile client.
  • No Developer Meta Delay: Pairing is completed directly without Meta Business Manager verification delays. You are solely responsible for keeping your physical phone active.

3 Acceptable Use & Anti-Spam Policy

To preserve network integrity and adhere to WhatsApp Business messaging policies, you strictly agree NOT to use Whaping for:

  • Sending unsolicited bulk broadcasts, promotional spam, or cold outreach to individuals who have not consented to receive messages.
  • Promoting illicit, restricted, or counterfeit products, unauthorized financial schemes, adult content, or gambling.
  • Engaging in deceptive, fraudulent, defamatory, or abusive behavior toward consumers.
  • Attempting to reverse engineer, decompile, or overload Whaping's underlying AI inference microservices.

Violation of this Acceptable Use Policy will result in immediate termination of your service without eligibility for refund.

4 Pricing, Early-Bird Offer & Billing

Whaping operates on a straightforward flat subscription pricing model:

  • Pre-Registration: Pre-registering before the official launch date (Coming Soon) is 100% free and requires no credit card.
  • Early-Bird Rate: Early-bird registrants lock in the discounted rate of ₹699 per month for their first 3 months of active service (standard rate: ₹1,000/month).
  • Annual Plan: The annual plan is billed at ₹7,999/year (including 2 complimentary months).
  • Zero Per-Message Markups: Whaping charges zero markup per message sent or received. You pay solely your flat software subscription fee.

5 Cancellation & Refund Policy

We believe in building software that delivers genuine revenue value:

  • Cancel Anytime: You may cancel your subscription at any time directly through your account dashboard or by notifying support. There are no lock-in contracts or cancellation penalties.
  • 7-Day Money-Back Guarantee: If you are not completely satisfied with Whaping within the first 7 days following your initial paid subscription billing, contact [email protected] for a full, prompt refund.

6 Intellectual Property & Data Ownership

You retain 100% ownership of your business name, logos, product catalogs, customer databases, and uploaded materials. Whaping retains all proprietary rights, trademarks, and copyrights in the Whaping platform, UI, algorithms, and AI agent orchestration engine.

7 Platform Disclaimer & Third-Party Services

Whaping is an independent automation software provider. WhatsApp and Meta are registered trademarks of Meta Platforms, Inc. Whaping is not endorsed, sponsored, or affiliated with Meta Platforms, Inc. While we target 99.9% uptime, we are not liable for temporary service interruptions caused by third-party mobile network outages, Meta infrastructure downtime, or local internet disruption.

8 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Whaping AI Technologies or its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the platform.

9 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the substantive laws of India. Any legal dispute or proceeding arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
